Terms and Conditions

BY USING THIS CAR PARK, YOU AGREE TO THE TERMS AND CONDITIONS LISTED BELOW. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE EXIT THE CAR PARK IMMEDIATELY.
 
1. The moment you drive your vehicle into this car park, you agree to the following Conditions, which are in effect 24 hours a day, 7 days a week. By entering, you also bind the vehicle’s owner to these Conditions and affirm that you have the authority to do so.
 
 
PAYMENT AND VIOLATION OF TERMS
 
2. You agree to adhere to the following rules: 
   a. Comply with all rules and directions displayed in the car park, as well as all relevant laws.
   b. Do not obstruct other individuals or vehicles using the car park.
   c. Do not park in areas marked “RESERVED,” “NO PARKING,” or outside of designated parking bays.
   d. Do not park in a mobility bay without a valid mobility window pass.
   e. Do not exceed the stipulated parking time for any bay.
   f. Ensure the vehicle you park is in safe working order, roadworthy, and always capable of being driven under its own power without posing any danger or risk to other vehicles, persons, or the car park.
   g. Pay upon entry or exit of the car park.
   h. A lost ticket will incur a charge of RM50 per day.
   i. Any fines must be paid upfront in case of disputes. Appeals should be made in writing to CENTRIO MANAGEMENT SDN BHD via email, and outcomes will be determined after an investigation by CENTRIO MANAGEMENT SDN BHD.
 
3. If you violate any of clauses 2 (a) to (g) of the Conditions, we reserve the right to apply a wheel clamp to your vehicle and/or have it towed at your own risk and expense. The vehicle will be held until all outstanding debts have been paid. The vehicle will be released upon payment of the release fee and any outstanding debts. The clamping fee is RM100.00 per day.
 
 
RESPONSIBILITY FOR DAMAGE AND INJURY
 
4. You are liable for any damage to the car park propertiesand vehicles caused by you or your vehicle.
 
5. While we shall take all responsible care, we cannot guarantee the security of your vehicle. 
 
6. We accept no liability for any claim by you or any other person, including (but not limited to) any claim for loss or damage to your vehicle or any other vehicle OR for loss or damage to the contents of your or any other vehicle OR resulting from using the carpark or being unable to use the carpark OR for negligence OR for personal injury OR otherwise. This applies even if we are negligent or in breach of this Agreement.
 
7. We accept no liability for any loss or damage to any article left in our custody or control.Notwithstanding anything to the contrary contained in this document, our employees are not authorized to accept any of your possessions for safe custody except for the keys to your vehicle where possession is taken at your request. 
 
8. You agree to indemnify us in respect of any claim made against us arising from your use of the car park or use of the car park by anyone else with your authority.
 
 
MISCELLANEOUS
 
9. You must provide us with your full name and address if asked by us. You agree that we may obtain the name and address of the owner of the vehicle from the motor vehicle register and pass this information to third parties for the purposes of debt recovery in accordance with these conditions.
 
10. If we fail to act or pursue any right or remedy available to us this will not in any way prejudice our right to exercise that or any other right or remedy.
 
11. No one is authorised to amend these Conditions on our behalf.
 
12. We may use automatic number plate recognition in this car park to monitor compliance with these conditions. We may use visual and audio surveillance and recording equipment in and around this car park for the purpose of protecting our lawful interests, and for protecting the safety and security of our employees, agents and contractors, and our customers.
 
 
INTERPRETATION
 
13. To avoid any confusion as to the meaning of these Conditions:
   a. “claim” includes any claim for damage, loss or compensation; and any damage or demand.
   b. “damage” includes direct, indirect, consequential and special damage.
   c. “outstanding debt” includes previous unpaid parking fees and/or unpaid enforcement notices.
   d. “vehicle” includes its accessories and contents.
   e. “Company”, “we” and “us” means CENTRIO MANAGEMENT SDN BHD. and/or includes any of its employees, agents and independent contractors.
   f. “you” includes both the driver and the owner of a vehicle entering this carpark.
   g. “your vehicle” means the vehicle which you are driving, regardless of whether it is owned by you.
   h. “notice” means Parking Enforcement Breach Notice.

SEASON PARKING TERMS AND CONDITIONS
   
1. Definitions and Interpretation 
   1.1 Amount Payable: Includes the Parking Fee, card security deposit, License Plate Programming Fees (LPR), administration fee, application fee, and/or any other monies payable in accordance with these Conditions.
   1.2 Company: Refers to the entity, its successors, and assigns, and, where applicable, its employees, agents, and contractors.
   1.3 Parker: Refers to any person who parks a vehicle in the car park under these Conditions and, where applicable, each passenger of that vehicle.
   1.4 Access Device: Any form of card or identification issued by the Company from time to time, including a pass check, access card, parking card, window pass, License Plate Recognition (LPR), windscreen token, sticker, or season pass.
   1.5 Parking Fee: The fee payable to the Company quarterly in advance, as described in Clause 2 below.
   1.6 Monthly/Quarterly Parker: Refers to Parkers who pay their Parking Fee monthly/quarterly in advance to the Company.
 
2. Parking Fees & Charges
   2.1 The Parking Fee must be paid to the Company either quarterly or monthly in advance, or as otherwise advised from time to time. Any other applicable Amount Payable must also be paid to the Company in advance, or as otherwise advised.
   2.2 The Amount Payable to the Company by the Parker does not include Sales and Service Tax (SST). These taxes are separately chargeable by the Company and must be paid by the Parker.
   2.3 The Company reserves the right to vary the Parking Fee or other charges at any time by providing existing Parkers with one (1) month’s written notice of the change.
   2.4 If a new fee becomes payable for parking provision in the car park, the Company will give existing Parkers one (1) month’s notice of the new fee. Upon expiry of the notice period, the Parker must pay the new fee for each vehicle subject to these Conditions.
   2.5 Payment for season parking is calculated on a monthly or quarterly billing cycle, as specified for each car park, and commences on the 1st day of the billing month. No pro rata or proportional allocation of fees will be applied or refunded for any unused portion of the billing cycle, regardless of the payment date.
   2.6 Failure to renew and make payment before the expiry date for all season parkers will incur an administration fee of RM50.00 for deactivation and reactivation of the season pass. If you enter the car park using a parking ticket and subsequently renew your season parking, you will not be allowed to exit using your Access Device until the accrued fee for entering with a parking ticket has been paid. No rebates or refunds will be given for such payments, nor will your parking ticket be validated for free. Please note that reminders are provided as a courtesy and are not obligatory. Each Season Parker is responsible for managing their own account. We will not be held responsible for any Season Parker not receiving reminder emails, whether in their inbox or junk email folder.
   2.7 A non-refundable, one-time fee of RM50.00 will be charged for processing each card for new motor vehicle applications; RM10.00 will be charged for processing each card for new motorcycle applications. This one-time account opening fee covers the processing of the new application, account maintenance, and any potential cancellation.
   2.8 If you do not reactivate your Access Device/Licence Plate Recognition (LPR) within two (2) weeks after the expiry date due to late payment, your account will be terminated, and you will need to submit a new season parking application. A charge of RM50.00 will be imposed for reactivating each season pass, and a non-refundable fee of RM60.00 will be imposed for reprogramming the Licence Plate Recognition (LPR).
   2.9 I agree to accept electronic invoices from Centrio Parking for billing and record-keeping purposes. All amounts shown on the invoice are due and payable as stated.
   2.10 For Season Parking applicants, refunds for parking tickets will only be processed the day after a payment is made, regardless of the chosen Start Date. For example, if the Start Date is 1st January but payment is received on 5th January, refunds will only be processed from 6th January onwards, until your parking access card is delivered to our car park Site Office for collection.
   
Please note that if a Season Parker makes payment before the Start Date, no refunds for parking tickets will be issued if the season card has already been delivered to the car park site office on or before the Start Date and remains uncollected by the parker.
 
Note: Refunds for tickets cannot be processed without scanning and emailing the original parking receipts to us. Additionally, the original parking receipts with the season card number written on the back must be handed to our car park site office for any refunds to be processed.
 
   2.11 For lost or damaged cards, refunds for parking tickets will only be processed from the day after online payment for a new card has been made, until the new card is received.
   2.12 If a Season Parker is unable to gain entry to the car park for valid reasons beyond their control, Centrio Parking will reimburse the parker up to a maximum of RM10 upon presentation of the original receipt. This reimbursement is subject to evidence provided by the Season Parker and is at the sole discretion of CENTRIO MANAGEMENT SDN BHD.
   2.13 For all cashless parking car parks managed by CENTRIO MANAGEMENT SDN BHD, refunds for parking payments made via Touch & Go (T&G) or credit/debit cards will only be processed the day after a payment for Season Parking is made, regardless of the chosen Start Date. For example, if the Start Date is 1st January but payment is received on 5th January, refunds will only be processed from 6th January onwards until your car registration number is activated in our system.
   
Refunds will not be processed if the transactions made via Touch & Go or credit/debit card have not been scanned and emailed to us for your claim.
 
Once we receive and verify your transactions and bank details, we will process the refund, which will take approximately three to four weeks from the date of receipt.
 
3. Denial of Access
   3.1 The Company reserves the right to deny the Parker access to the car park if any Amount Payable remains unpaid after the due date.
   3.2 If the Parker is found to have violated the conditions of entry and conduct for the car park, the Company reserves the right to terminate the parking privileges.
   3.3 In the case of multiple cards under a single account, all cards will be denied access if any Amount Payable remains unpaid after the due date.
   For Licence Plate Recognition (LPR) car parks, if any Amount Payable remains unpaid, the Company will not reimburse you for daily charges as your car registration will be blocked. You will only be able to exit by paying the daily hourly rate, with no refunds given. You must reactivate your account immediately by paying the penalties for late payment.
 
 4. Additional Parking
   4.1 These Conditions apply to any additional parking spaces provided by the Company to the Parker in the car park.
   4.2 Any additional parking granted beyond the agreed permanent allocation is temporary and may be withdrawn upon one (1) month’s written notice of termination from the Company via email.
 
5. Termination
   5.1 Either party may terminate the season parking by providing one (1) month’s written notice to the other at any time.
   5.2 The Company reserves the right to terminate the season parking of all related accounts of the parker immediately if the Parker breaches these Conditions.
   5.3 The balance of the refund upon termination will be processed upon receipt of the Access Device no later than the last day of the notice period. If the Access Device is not returned on the due date in good condition (e.g., not physically damaged or disfigured), no security deposit will be refunded for the Access Device. The balance for the unused portion of the season parking (if any) after the one month’s notice will only be calculated from the date the Access Device is returned to us and verified with our official receipt. No refund or rebate will be provided to any Parker with less than five (5) working days remaining in their season parking term.
   5.4 No security deposit will be refunded if the Access Device is returned to the Company after the due date of termination or non-renewal of the season parking. As stated in the Season Parking Terms & Conditions regarding definitions and interpretation, an Access Device refers to any form of card or identification issued by the Company from time to time, including a pass check, access card, parking card, window pass, windscreen token, sticker, or season pass issued to the Season Parker. If the access card is returned without the sticker, a charge of RM30.30 will be deducted from the access device deposit amount.
   5.5 If a Parker loses their Access Device and pays for a replacement, no refund or rebate will be provided if the original Access Device is subsequently found or recovered.
   5.6 Any verbal abuse, physical threat, or intimidation towards our staff will result in the immediate termination of season parking.
   5.7 Any Season Parker found guilty of allowing others to use their card to enter or exit the car park is in breach of our Terms & Conditions. The Parker’s account will be terminated immediately, and their cards will be confiscated. No refunds will be provided for any unused balance or card deposit. Depending on the severity and number of breaches, the Season Parker may also be banned from using the car park services.
  
6. Bay Allocation
   6.1 Unless otherwise agreed upon, the Parker will not have exclusive use of any specific parking bay.
   6.2 Each Reserved bay is intended solely for one (1) designated Parker. Any vehicle other than the designated Parker’s registered vehicle parked in a Reserved bay will be wheel clamped, and a fine as stated in tariff board will be imposed if no prior written notification of a change in the Parker’s vehicle registration number has been provided to the Company.
   6.3 The Parker with a Reserved bay shall not allow other vehicles to park in the Reserved bay except for the Parker’s vehicle that has been registered with the Company.
 
 7. Duties of the Parker
   7.1 The Parker must:
       a. Allow the Company access to any part of the car park at any time for the purpose of inspections, necessary repairs, or any other purpose specified by the Company.
       b. Observe and adhere to all rules and regulations regarding the use of the car park as issued by the Company from time to time.
       c. Use the car park only during its operating hours, which may vary from time to time; and
       d. When the season parking involves more than one bay, maintain records of the relevant Access Devices and corresponding parker details, and provide them to the Company upon request.
       e. Enter the car park only using the Parker’s Access Device. No refunds or rebates will be provided, and parking tickets will not be validated if the Parker does not enter using the Access Device. The Parker must pay for any parking ticket used to enter the car park before being allowed to exit.
       f. All fines must be paid upfront to CENTRIO MANAGEMENT SDN BHD. Any appeals by the Parker should be made via email. Outcomes will be communicated to the Season Parker after investigations have been conducted by CENTRIO MANAGEMENT SDN BHD.
       g. For cashless car parks using Licence Plate Recognition (LPR), the parker must inform the Company of any change in car registration number and pay the current reprogramming fee (RM60) for the change before the new car registration number can be activated. Failure to do so will prevent the parker from entering or leaving the car park. In this case, the parker will have to pay the daily rate, which is non-refundable..
       h. An LPR Season Parker may register more than one car on their account for LPR; however, only one car is allowed to enter or exit the car park at any given time.
   i. If two cars registered under the same parker’s account enter or exit simultaneously, all car registration numbers will be blocked, and an LPR reprogramming fee of RM60 will be required to reactivate each car.
  
8. Security Deposit and Other Initial Payments
   8.1 The security deposit must be paid to the Company before the commencement date of parking and will be retained by the Company.
   8.2 A non-refundable amount of RM80.00 is payable for the fabrication of each reserved sign. An additional non-refundable fee of RM35.00 will be charged for each subsequent change of the vehicle’s registration number (excluding the initial registration number) for Reserve bay parkers.
 
 9. Access Devices
   9.1 Each Access Device is and remains the property of the Company.
   9.2 If the Parker does not have a valid Access Device when entering or leaving the car park, they will be liable to pay the maximum ordinary daily parking tariff charged by the Company.
   9.3 The Parker must pay RM60.00 to the Company for the replacement of a lost or damaged Access Card device before a new card can be issued. Refunds for parking tickets used to enter the car park while waiting for the new access card device can only be claimed a day after payment for the lost/damaged card is made. A charge of RM26.50 will be applied for each lost or damaged windscreen sticker. Only one windscreen sticker will be provided for each season card holder. If the Parker finds and returns the lost access device and/or sticker at a later date, no refund will be issued if a card/sticker has already been replaced.
   9.4 Physically damaged (e.g., warped, dented, bent, ripped, or disfigured) returned Access Devices will result in the forfeiture of one (1) month’s security deposit refund, regardless of whether the cards are still functional.
   9.5 Any violation or misuse of the season parking card, including illegal passback, will result in either the cancellation of season parking or a penalty fee of no less than RM60 per card per day. The charge will be determined by the extent of the violation by the cardholder. CENTRIO MANAGEMENT SDN BHD reserves the right to impose penalties according to the severity of the breach. If the violation results in cancellation of the Season Pass, no refunds will be paid to the Season Pass holder. All Season Card Holders’ passes are non-transferable and cannot be used by any other person to gain entry or exit from the car park. The Season Parker may also be banned from using the car park services.
 
 10. No Safe Custody
    10.1 No employee, agent, or contractor of the Company has the authority to accept any goods for safe custody. The Company will not be liable for any loss of or damage to any article alleged to have been left with the Company or any employee, agent, or contractor for safe custody, regardless of how the loss or damage is caused.
 
 11. Alteration of Terms and Conditions
    11.1 The Company reserves the sole right to modify these Conditions by adding, altering, or deleting any of them without prior notice. It is your responsibility to check these Conditions on the website, which are clearly displayed at www.mycentrio.com.
  
12. Waiver
    12.1 Any time or other indulgence granted by the Company to the Parker will not constitute a waiver of any of its rights under these Conditions or at law. The Company will not be precluded from exercising any such rights against the Parker.
 
 13. Relationship
    13.1 Nothing in these Conditions creates or will be construed as creating any tenancy or conferring any interest upon the Parker by way of lease or otherwise in the car park or any part of it.
 
 14. Assignment
    14.1 The season parking is personal to the Parker, and the Parker must not assign any rights or obligations under the season parking without the prior written consent of the Company.
  
15. Customer Vehicle Assistance
    15.1 If, at the request of the Parker, the Company provides any form of vehicle assistance to the Parker, including but not limited to re-charging the battery of the Parker’s vehicle:
    15.2 The Parker accepts such assistance at the Parker’s own risk in all respects; and
    15.3 If any damage is caused to the Parker’s vehicle, the Parker releases and indemnifies the Company from and against any claim that the Parker may otherwise have against the Company in respect of that damage.
 
 16. Conditions of Entry and Limitation of Liability
    16.1 The conditions of entry and limitation of liability displayed at the entrance to and throughout the car park are incorporated into these Conditions and apply to them as if they were set out in full.
    16.2 In the case of any inconsistency between these Conditions and the Conditions of entry and limitation of liability, these Conditions will prevail.
  
17. Miscellaneous
    17.1 You confirm that you have read, understood, and agreed to the Customer’s Data Protection Policy.
  
18. Service of Notices for Bills, Statements, Reminders, and any Communication.
    18.1 The Company assumes no responsibility for any non-delivery of notices for bills, statements, reminders, and/or any communication. All notices for bills, statements, reminders, and/or any communication shall be deemed to have been duly delivered in any of the following manners:
         a. By email, by correctly inputting the Parker’s email address on record, and noting that the email has been sent out without any delivery failure notification.
         b. The Parker must use the email address registered with the Company for communication. The Parker is advised to check their mailbox (including Junk/Spam folder) for any emails sent by the Company.
         c. The Parker must immediately notify the Company of any changes to their email address.
